SEC Proposes New Token Sale and Electronic Delivery Rules for 2026

The U.S. Securities and Exchange Commission announced two regulatory proposals slated for July 2026. The first aims to legalize token sales by providing a time‑limited registration exemption for early‑stage crypto projects, creating a "safe harbor" that would allow tokens to lose securities status once sufficiently decentralized. The proposal is under review by the White House.

The second proposal, called Regulation E‑Delivery, would replace the current opt‑in framework for electronic delivery of investor information with a rule‑based system permitting e‑delivery without prior affirmative consent, while preserving recipients' rights to receive paper documents. Both proposals seek to modernise securities rules in response to growing use of digital and blockchain technologies.
