SeNaSa 2.0 case: Defense lawyers challenge investigation methodology
Defense attorneys for 26 defendants in the SeNaSa 2.0 case have raised significant challenges during coercion measure hearings in Santo Domingo. The investigation involves allegations of medical procedures being billed and collected without being performed.
Lawyer Santos Willy Liriano Mercado, representing Dr. Anna Rachel Rodríguez Almánzar, argued that many implicated doctors are victims of a systemic issue. He contended that medical records are legally the responsibility of clinical centers rather than individual physicians, citing Ministry of Public Health regulations. Liriano also accused the Public Ministry of forcing non-voluntary agreements with nine defendants to avoid preventive detention, while requesting 18 months of preventive prison for those who do not cooperate.
Other defense counsel, including Adalquiris Lespín Abreu, representing Juan Henry Poueriet, questioned the methodology of the investigation. They alleged that the Public Ministry is building cases based on unverified statements from other defendants rather than independent evidence. The prosecution seeks to declare the case complex, which would impact the legal proceedings for the doctors and former SeNaSa employees involved.
