Senate Republicans plan rapid Supreme Court confirmation strategy

Senate Republicans are developing a legislative strategy to rapidly confirm a Supreme Court nominee during the post-election lame-duck session of 2026. This planning targets the five-week window between the November 3 midterm elections and the start of the new Congress in early January 2027.

The strategy is driven by the competitive battle for Senate control. Republican leadership aims to utilize the current majority to confirm a conservative justice if a vacancy arises, fearing that a Democratic takeover of the Senate would lead to gridlock or blockades for any future appointments under President Donald Trump.

Senate Majority Leader John Thune and Senate Judiciary Chair Chuck Grassley have indicated that the caucus would proceed quickly to fill any empty slots. Such a compressed timeline would be historically rare, as a post-election retirement during a lame-duck session has not occurred since 1922, though Republicans point to the 38-day confirmation of Justice Amy Coney Barrett in 2020 as a modern precedent.
