Senegal government challenges special funds bill at Constitutional Council

The Senegalese government has petitioned the Constitutional Council to challenge the admissibility of a proposed law aimed at regulating special funds, often referred to as ‘political funds.’ The Executive argues that certain provisions of the bill infringe upon the regulatory domain reserved for the government under Articles 67 and 76 of the Constitution.

In response to this legal challenge, the National Assembly announced the suspension of its plenary session, originally scheduled for August 19, 2026. While the Assembly noted that the Constitutional Council's referral does not carry an automatic suspensive effect under the current Constitution or internal regulations, it chose to halt the debate in the interest of ‘republican elegance’ and institutional stability.

The dispute highlights a significant tension between the legislative and executive branches regarding the transparency and parliamentary oversight of public resources. Opposition members, including deputy Amadou Ba, have criticized the move as an attempt to obstruct accountability, while proponents of the bill, such as deputy Guy Marius Sagna, seek stricter controls on how these special credits are managed.
