Serbia proposes real estate law amendments for property registration

The Serbian Government has adopted a proposal to amend the Law on Special Conditions for the Recording and Registration of Rights to Real Estate. The changes aim to refine the calculation of land development fees and simplify the registration process for property owners.

Under the new rules, family residential buildings up to 400 square meters will follow the existing fee model. For properties exceeding 400 square meters, fees will only be charged for the area above that threshold. This measure is intended to distinguish multi-generational family homes, particularly in rural areas, from commercial developers.

The amendments also address registration challenges when developers are unavailable or fail to meet financial obligations. If a developer does not pay the required fees, the Agency can issue ownership certificates for individual apartments with a notation of unpaid fees. This allows apartment owners to register their property without being forced to pay the developer's debt, though they retain the option to pay it to clear the notation. In cases of non-payment, the State Attorney's Office will initiate compulsory collection procedures.
