Sergas ordered to pay indemnity for workplace harassment in Vigo

The High Court of Justice of Galicia (TSXG) has ordered Sergas to pay an indemnity of approximately 38,500 euros to a worker in the Vigo health area for violating fundamental rights regarding physical and moral integrity.

The worker, who began working in the Vigo area in 2019, reported workplace harassment by the Human Resources department starting in 2020. The court found that the regional administration failed to meet legal obligations regarding the prevention of psychosocial risks. The employee faced derogatory comments, ambiguous task assignments, and was eventually denied access to necessary software applications, which hindered his ability to perform duties and impacted primary care services.

While the court acknowledged that Sergas eventually took steps to adapt the worker's position and distance him from conflicting parties, it ruled these measures were “tardías y no responden a una iniciativa preventiva” (late and do not respond to a preventive initiative), but rather aimed at correcting a problem that had already manifested.
