Sicilian court suspends anti-mafia ban on Aragona waste company

The President of the first section of the Sicilian TAR has urgently suspended a measure that would have removed E. D. S. srl, a waste management company based in Aragona, from the Register of Environmental Managers.

The legal battle began in late July when the Prefecture of Agrigento issued an anti-mafia interdictory measure against the company, citing suspected mafia influence based on certain evidentiary elements. This triggered a domino effect, leading the Ministry of Environment and Energy Security to cancel the firm's registration, which threatened to immediately halt its operations and existing private contracts involving non-hazardous waste and scrap processing.

Legal counsel for the company argued that the measures violated the right to a contradictory process, claiming the Prefecture relied on circumstances never previously contested during the investigation. They also cited a lack of sufficient motivation and investigation regarding the relevance of the evidence used. The court's suspension allows the company to continue its current activities and maintain its contractual obligations.
