Skûlenboarch solar park construction allowed to continue by court

A Dutch court has rejected a request by Stichting Natuurwet to halt the construction of a floating solar park in Skûlenboarch. The foundation argued that the project destroyed foraging areas for white-tailed eagles and lacked necessary permits for flora and fauna activities.

Previously, the provincial government had imposed a penalty of up to 475,000 euros to ensure work only resumed after an approved nature assessment proved no protected species, such as the white-tailed eagle, kingfisher, or otter, were being disturbed. The foundation sought to strike specific conditions from this penalty to effectively force a total construction stop, arguing the current terms were insufficiently concrete. However, the judge ruled that the existing penalty still enforces the legal duty of care and denied the request to suspend the terms.
