São Paulo Court Annuls Decree Eliminating Environmental Research Institutes
A São Paulo state judge, Erika Folhadela Costa of the 2nd Vara da Fazenda Pública, ruled on 28 July that Decree No. 65.274, signed on 26 October 2020 by then‑governor João Doria, was illegal and nullified it. The decree had abolished the Horto Florestal, the Instituto Geológico and the Instituto de Botânica and transferred their functions to a newly created Instituto de Pesquisas Ambientais managed by the Fundação Florestal.
The court found the decree exceeded the governor’s regulatory authority, ordering the state to refrain from any further changes to the research structure or scientific programs of the three institutes until a technical justification is provided and approved by the relevant conservation councils, the Biodiversity Thematic Commission and the State Environmental Council. The decision can be appealed. The action was filed by the Instituto Brasileiro de Proteção Ambiental (Proam), whose president Carlos Bocuhy highlighted the institutes’ role in the climate‑emergency context.
