São Paulo court increases fine for luxury brand counterfeiting
The Court of Justice of São Paulo (TJSP) has increased a moral damages fine from R$ 5,000 to R$ 50,000 against a company found to be systematically counterfeiting luxury brands. The decision follows a Federal Revenue operation that seized over 7,300 counterfeit items, with an estimated value of R$ 150,000.
The court's 2nd Reserved Chamber of Business Law noted that the scale of the operation indicated a manufacturing structure dedicated to the systematic reproduction of third-party brands rather than isolated incidents. The ruling emphasized the gravity of the violation, citing the worldwide recognition of the luxury brands involved and the significant discrepancy between the company's reported capital and the value of the seized goods.
