São Paulo court orders compensation for Black worker forced to change appearance

A Brazilian labor court has ordered a company in São Paulo to pay R$ 20,000 in moral damages to a Black store inspector who was forced to cut his hair and shave his beard to meet corporate aesthetic standards.

The 34th Labor Court ruled that the employer's demands constituted aesthetic discrimination and an abuse of managerial power. The judge noted that the worker's hair and beard were already trimmed, yet he was ordered to undergo further changes without any sanitary or safety justification.

In the ruling, Judge Marcela Carine dos Prazeres Soares stated that characterizing Black hair and beards as 'stigmas' to be eliminated for corporate credibility perpetuates the systematic devaluation of Black bodies and creates racist barriers in the labor market. The decision also recognized the right to indirect termination of the employment contract.
