São Paulo Court orders state to correct transgender woman's medical records
The Court of Justice of São Paulo (TJSP) has ordered the State Government to correct the registration of a transgender woman across all databases linked to the State Health Secretariat. The ruling follows an incident where a patient, despite having a birth certificate identifying her as female, was incorrectly recorded as male in hospital guides and radiological reports.
The 6th Chamber of Public Law determined that the failure to respect the patient's gender identity violates personality rights and the constitutional principle of human dignity. In addition to the mandatory registry corrections, the court ordered the state to pay R$ 2,000 in moral damages to the patient.
