São Paulo court orders state to indemnify teacher assaulted at school

The Court of Justice of São Paulo has ordered the state government to pay 5,000 reais in moral damages to a teacher who was assaulted by a student at a public school in Cubatão.

The incident occurred in 2024 at the Deputado Waldomiro Mariano State School. The teacher, then 62 years old, was reportedly pushed by a 15-year-old student after asking him to stop talking during an evaluation. The fall caused the teacher to strike a metal basket, resulting in facial and torso bruising, as well as physical and psychological consequences.

While the state appealed, arguing the assault was the sole responsibility of the student and unpredictable, the Second Recursal Chamber of Public Finance upheld the ruling. Judge Lúcia Caninéo Campanhã stated that the State has an obligation to ensure the well-being of workers during their professional duties.
