São Paulo court suspends power restrictions for Avenida Paulista artists

A court in São Paulo has issued an injunction partially suspending a municipal ordinance that restricted street artists on Avenida Paulista from using external energy sources to power sound equipment. The rule, implemented by the city administration during the ‘Ruas Abertas’ program on Sundays and holidays, had prohibited the use of generators, batteries, and electrical connections to nearby businesses or residences.

Judge Antonio Augusto Galvão de França ruled that the prohibition was disproportionate, noting that the method of powering equipment does not inherently dictate noise levels. The court emphasized that existing technical tools and decibel meters are sufficient to monitor noise pollution. Furthermore, the decision highlighted that the restriction could hinder the free exercise of cultural expression and negatively impact the livelihoods of local artists.

While the injunction restores the use of external power sources, it maintains safety regulations. The city may still enforce rules regarding urban organization and pedestrian safety, meaning the installation of loose cables, wires, or combustion generators that pose a risk to public circulation remains prohibited. The São Paulo City Hall has stated its intention to appeal the decision.
