São Paulo Court upholds conviction of treasurer for embezzling funds for gambling
The 12th Criminal Law Chamber of the São Paulo Court of Justice (TJSP) has upheld the conviction of a public servant for embezzlement. The woman, who served as the treasurer for the Guaimbê Municipal Chamber, diverted funds to finance gambling.
Investigations revealed a loss of R$ 99,000 to public coffers. The court noted that the defendant repeatedly withdrew money over several months and falsified bank statements to hide the illicit transactions. Although she returned a portion of the funds, the court ruled this demonstrated an awareness of the illegality rather than a lack of intent.
The defendant's argument that online gambling addiction impaired her ability to make decisions was rejected, as medical professionals did not conclude she lacked self-determination. She was sentenced to two years, four months, and 24 days of imprisonment in an open regime, which was replaced by community service and a fine of 65.8 minimum wages payable to the Municipal Chamber.
