São Paulo officials dispute court ruling on city zoning laws
The Public Ministry and the São Paulo City Council have filed motions against a Court of Justice decision regarding the city's zoning laws, reigniting a legal dispute over urban development.
The conflict centers on the deadline for filing projects based on the July 2024 zoning map, which the Court of Justice recently declared unconstitutional. The Court had previously ruled that permit requests submitted to the City Hall by the date of the ruling's publication could still follow the July rules.
The City Council is seeking an extension of this filing deadline until all legal appeals are exhausted, which would allow developers more time to register projects—such as taller buildings in neighborhoods like Vila Mariana and Perdizes—under the contested regulations. The Council argues that legal effects should remain valid until a final judicial decision is reached. Conversely, the Public Ministry is opposing this extension, arguing that allowing such a deadline would undermine the ruling on the law's unconstitutionality.
