SOBOCE notified to pay Bs 744 million to FANCESA
Sociedad Boliviana de Cemento (SOBOCE) has reported receiving a judicial notification requiring a payment of Bs 744,315,432 to FANCESA. The order was issued by the 11th Civil and Commercial Public Court of Sucre, granting a 20-day deadline for compliance.
SOBOCE has contested the requirement, stating that the resolution is currently under constitutional review and remains subject to pending legal actions. The company warned that if the deadline passes, a coercive execution process could be triggered, which it describes as an “act of irresponsibility” because the Constitutional Court had previously annulled the resolution due to alleged irregularities.
The company is seeking a precautionary measure from the Second Constitutional Chamber of the La Paz Departmental Court of Justice to halt the execution while a complaint regarding the non-compliance of Constitutional Resolution 136/2025 is addressed. SOBOCE characterized the requested amount as an “unusual indemnity lacking technical and legal support” and noted that the legal dispute stems from allegations of unfair competition, which the company denies. Additionally, SOBOCE noted a long-standing dispute regarding unpaid compensation for the expropriation of its shares in FANCESA by the State.
