Social Court Detmold rules on Jobcenter housing cost liability
The Social Court Detmold has ruled that a Jobcenter is not required to cover retroactive operating cost surcharges if the housing costs were previously deemed inappropriate.
In a specific case (Az. S 16 AS 693/22), a mother receiving SGB II benefits was faced with a €388.39 surcharge for operating costs. The Jobcenter had initially only approved €454.35 per month, which was below the actual gross cold rent. The court determined that because the authority had already signaled that it would not recognize the full rent amount, the recipient was aware that any excess costs would need to be covered by their own funds or regular benefits. Consequently, the responsibility for the surcharge remained entirely with the individual.
