Sorriso judge denies sanity exam for man accused of killing son

A judge in Sorriso, Mato Grosso, has denied a defense request for a mental sanity examination for Rairo Andrey Borges Lemos, who is accused of killing his two-year-old son, Davi Lucca. Judge Rafael Deprá Panichella ruled that the defense failed to provide technical evidence, such as psychiatric reports or medical history, to substantiate claims of mental instability.

The defense argued that Lemos suffered intense psychic disturbance following the end of his relationship with the child's mother, leading to a temporary loss of discernment. However, the judge noted that medical records from the night of the incident showed Lemos had normal vital signs and a Glasgow scale score of 15, indicating full consciousness and immediate communication with police.

The judge stated that emotional distress resulting from a breakup does not equate to criminal insanity. Lemos has been pronounced for homicide with aggravating factors, including base motive, cruel means, and the use of resources that hindered the victim's defense. He also faces charges for the irregular possession of ammunition. The defendant remains in preventive detention.
