South Africa Constitutional Court blocks Shell oil exploration

South Africa’s Constitutional Court has blocked offshore fossil fuel exploration led by Shell and Impact Africa along the country’s Wild Coast. The ruling overturns a 2024 Supreme Court of Appeal judgment that had previously supported the companies' rights to conduct seismic surveys.

The decision follows legal challenges from environmental organizations and local communities in the Eastern Cape province. Plaintiffs argued that authorities failed to conduct meaningful public consultations and neglected the potential impacts on marine life, climate change, and the spiritual and cultural rights of coastal residents.

In the majority opinion, Justice Jody Kollapen emphasized that public participation is more than a procedural requirement, stating it is a process that “affirms human dignity by affording a seat at the table to those whose lives are impacted by decisions.” The court also noted the historical context of resource dispossession and referenced international obligations regarding climate change and scientific diligence.

Shell has stated it remains committed to responsible offshore exploration and environmental stewardship despite the setback. The company is also exploring the Orange Basin on South Africa’s west coast.
