South Africa Constitutional Court blocks Shell Wild Coast exploration

South Africa’s Constitutional Court has issued a landmark judgment setting aside exploration rights held by Shell and Impact Africa for oil and gas searches off the Wild Coast. The ruling concludes a five-year legal battle initiated in 2021 by environmental organizations and local communities.

The Court found that the government’s decision to grant the exploration rights was fundamentally flawed due to inadequate consultation with affected communities. The judgment emphasized that these communities must have a meaningful opportunity to participate in decisions that impact their livelihoods, cultural practices, and the marine environment.

This case marks the first time a climate-related dispute has reached South Africa’s highest court. Beyond the potential harm to marine ecosystems from seismic surveys, the legal challenge questioned whether the climate impacts of new offshore petroleum exploration had been properly considered. The ruling prevents the companies from proceeding with seismic surveys or seeking a renewal of the exploration rights based on the previous flawed approval process.
