South Korea passes criminal procedure law overhaul, sparking political and legal backlash
On July 31, South Korea's National Assembly approved an amendment to the criminal procedure law that eliminates the prosecutor's supplementary investigation (보완수사) authority, creates a Public Prosecution Office and a Serious Crime Investigation Agency, and adds pre‑charging provisions for seven serious crimes involving vulnerable victims.
The ruling Democratic Party held a nationwide public briefing, defending the reform as a necessary overhaul of the criminal justice system and announcing further legislation to protect victims. Opposition parties and legal scholars warned that the removal of the prosecutor’s investigative tool could weaken police oversight, raise constitutional questions about the prosecutor’s warrant‑request power, and increase the risk of wrongful prosecutions.
The People Power Party demanded President Yoon exercise his veto power and accused the government of politicising the amendment. The Supreme Court said judges must consider the prosecutor’s intent when applying the new dismissal criteria. Justice Minister Cho Seong‑ho said any adverse effects would be corrected promptly.
