The Seoul Administrative Court has ruled that employee dismissals are invalid if a company fails to follow established disciplinary procedures, even if the grounds for dismissal are legitimate. In a recent case involving an engineering services firm, the court upheld a decision by the National Labor Relations Commission to overturn the dismissal of three employees. The company had failed to meet the required quorum for its disciplinary committee and did not conduct anonymous secret ballots as mandated by its own rules. The court noted that even if absent members later reviewed recordings of the meeting, the procedural flaws remained unrectified.

Separately, a legislative forum held at the National Assembly addressed the need to evolve South Korea’s debt restructuring policies. Experts argued that current measures focus too heavily on simple debt adjustment rather than fostering long-term economic independence for vulnerable debtors. Proposals included expanding the scope of the Credit Counseling and Recovery Service to integrate debt relief with employment, welfare, and housing support through a more robust inter-agency collaboration system.
