South Korean court overturns demotion of Air Force member for disparaging superior

A South Korean court has ruled that the demotion of an Air Force member for making disparaging remarks about a superior was excessive. The Seoul Administrative Court ruled in favor of the plaintiff, an Air Force member, in a lawsuit against a brigade commander to cancel a disciplinary action.

The incident occurred in 2024 when the individual made remarks about a superior in front of fellow soldiers, using profanity and describing the officer as a “useless officer” who does nothing in their department. While the court acknowledged that the remarks were made and characterized them as “imprudent, rude, and indiscreet,” it determined that the comments did not intend to undermine the military chain of command or disparage the officer's official status.

The court noted that the superior did not personally hear the remarks and there was no evidence that military discipline or the order of command was actually disrupted. Consequently, the court found that a one-rank demotion violated the principle of proportionality and constituted an abuse of discretionary power. Under military disciplinary regulations, such minor misconduct should be met with lighter penalties, such as confinement or reprimand.
