South Korean court sentences three for unauthorized North Korean drone flights

A South Korean court has issued suspended prison sentences to three individuals for flying unauthorized drones into North Korean airspace. The Seoul Central District Court sentenced a graduate student in his 30s to eight months in prison, suspended for two years, while two drone manufacturers received six-month sentences, also suspended for two years.

The defendants were accused of flying drones across the Military Demarcation Line (MDL) into the Kaesong area on four occasions between September 2025 and January 2026. Two of the drones crashed in North Korean territory, leading to heightened inter-Korean tensions and public statements from Pyongyang.

While the court found the defendants guilty of violating the Aviation Safety Act by operating drones exceeding the 2kg reporting threshold without authorization, it acquitted them of charges related to “benefiting the enemy in general.” The court ruled that there was insufficient evidence, such as the presence of an SD card, to prove that sensitive military flight data or information was actually transferred to North Korea. The court noted that providing a provocation for North Korea or causing a military response does not inherently constitute a breach of South Korea’s military interests under the specific charge of aiding the enemy.
