South Korean NEC special prosecutor seeks tax probe amid warrant rejections
The special prosecution team led by Lee Tae-han, investigating allegations surrounding the National Election Commission (NEC), has requested a tax investigation from the National Tax Service. The team identified signs of tax evasion and fraudulent transactions by companies allegedly involved in bid-rigging and preferential private contracts with the NEC.
Simultaneously, the investigation faces legal hurdles as the Seoul Central District Court recently rejected search and seizure warrants and communication warrants requested by the special prosecutor. The court cited the potential for significant disruption to the NEC’s normal operations and noted that basic facts had already been established.
These developments have sparked debates regarding judicial neutrality. Because high-ranking judges often serve as NEC chairpersons or members, legal experts are calling for measures such as the designation of dedicated trial courts or the use of citizen participation trials to prevent potential conflicts of interest and ensure public trust in the legal process.
