Spain: Courts uphold dismissals for early arrival and unapproved leave

Spanish courts have recently upheld two distinct cases involving disciplinary dismissals related to workplace conduct and scheduling.

In Alicante, the Social Court No. 3 validated the dismissal of a logistics employee who consistently arrived 30 to 45 minutes before her scheduled start time. The court ruled that despite the employee's intent to manage her workload, the habit constituted a serious fault that breached the relationship of trust and loyalty with her employer.

Separately, the High Court of Justice of Navarre confirmed the dismissal of an employee with nine years of seniority. The individual had extended his summer vacation by 17 days to travel to Ecuador without obtaining the required written authorization from the company. Although the employee claimed he had received verbal permission from a supervisor, the court upheld the company's decision to terminate his employment.
