Spain establishes new regulatory framework for Strategic Investment Projects
Spain has published Royal Decree 731/2026, which establishes the framework for the Strategic Investment Projects (PEI) Committee. This regulation defines the criteria and procedures for recognizing business investments or public-private partnerships as strategic initiatives that contribute to the country's technological, scientific, industrial, or productive capacities.
To qualify for PEI status, projects must demonstrate significant public interest through economic, social, or environmental contributions. Key evaluation criteria include investment volume, job creation, contribution to strategic autonomy, energy transition, decarbonization, and the development of critical technologies. The decree specifically aims to support industrial reindustrialization and the development of areas facing demographic challenges.
The regulation also addresses the saturation of the electrical grid caused by the intensive deployment of renewables and energy-intensive investments, such as data centers and renewable hydrogen projects. By establishing reinforced governance, the decree seeks to prioritize grid access for solid projects that enhance industrial leadership. Purely financial operations, such as capital increases or structural modifications, are expressly excluded from this designation.
