Spain faces 935 million euro debt in U.S. renewable energy rulings

Spain faces increasing legal pressure in the United States regarding unpaid compensations to renewable energy investors. Recent rulings by the U.S. District Court for the District of Columbia have added 98 million euros in liabilities following cases involving companies such as OperaFund, Schwab, Steag, and Renergy. This brings the total debt recognized by U.S. courts against the Spanish state to 935 million euros.

These legal battles stem from decisions made over a decade ago to unilaterally reduce renewable energy premiums. International arbitration tribunals, including CIADI, have ruled that these actions violated investors' legitimate expectations of regulatory stability. Globally, Spain faces nearly thirty such arbitration awards, with total compensations and interest estimated at approximately 2.35 billion euros.

While the European Commission has provided a legal shield by exempting Spain from certain payments to prevent them from being classified as illegal state aid, investors and opportunistic funds continue to pursue litigation and asset seizures in various jurisdictions to recover their funds.
