Ecuador's Noboa decree limits condo common‑area use for owners in arrears

President Daniel Noboa Azín signed Executive Decree No. 462 on 31 July 2026, reforming the General Regulation of the Horizontal Property Law in Ecuador. The reform strengthens collection mechanisms for unpaid condominium fees, reserve‑fund contributions, interest and collection costs. Administrations may now restrict access to non‑essential common areas – such as swimming pools, gyms, communal halls, sports courts, visitor parking, terraces, BBQ zones and coworking spaces – for owners who are in default. The decree also requires monthly publication of payment status and conditions voting rights on the owners’ assembly on the settlement of dues.

Essential services cannot be suspended: water, sanitation, basic security, evacuation routes, and access for emergency personnel, as well as accommodations for people with disabilities, pregnant women and other vulnerable groups. Payment agreements must be written; missing two installments triggers immediate acceleration of the full outstanding balance. Re‑incidence is defined as a new default within twelve months after full regularisation, though no additional penalties are specified. The decree entered into force upon its publication in the Official Register.
