Spain implements new labor transparency regulations

New labor regulations in Spain, established under Royal Decree 723/2026, mandate that companies provide written information regarding working conditions to employees. The measure, which partially incorporates European Directive 2019/1152, aims to increase transparency and predictability in the workplace.

Employers are required to disclose specific details including base salaries, salary supplements, payment frequency, and the criteria used to calculate variable compensation. Regarding working hours, companies must provide information on daily, weekly, and annual distributions, shift change procedures, night work, overtime compensation, and vacation periods.

Additionally, the regulation requires clarity on professional categories, job responsibilities, and the duration and conditions of probationary periods. A notable inclusion is the requirement to inform employees about the use of certain artificial intelligence systems in the workplace.

The rules apply to labor relations exceeding four weeks, regardless of company size. Information must be provided before employment begins, though existing employees may request missing details, which companies must provide within 30 business days. Documentation can be provided in paper or electronic formats, provided it is accessible, printable, and understandable for persons with disabilities.
