Spain labor absenteeism rises amid legal reforms for disability
Spain is experiencing a structural rise in labor absenteeism, with the national rate reaching 5.21% in 2025. This trend is driven largely by an increase in temporary incapacity processes.
In the Government of Navarra, absenteeism has reached a historic high. Public employees averaged 21.08 days of absence in 2025, a 18.8% increase from 2021. Despite the administration growing to over 31,000 employees, the absenteeism rate hit a record 6.11%.
In response to evolving legal standards, Spanish labor law has been updated via the reform of Article 49 of the Workers' Statute. Following jurisprudence from the Court of Justice of the European Union regarding the 'Ca Na Negreta' case, companies can no longer automatically terminate contracts due to permanent disability. Employers are now required to evaluate reasonable accommodations or the availability of compatible roles to prevent discrimination and preserve employment.
