Spain labor laws mandate specific rest periods and weekly breaks
Under the Spanish Workers' Statute, employees are entitled to specific mandatory rest periods to ensure physical and mental recovery. One fundamental right is the minimum of 12 hours of rest between the end of one workday and the start of the next. This limit is mandatory and cannot be bypassed even through mutual agreement between employer and employee.
Regarding weekly rest, Article 37.1 stipulates that workers are entitled to a minimum of one and a half uninterrupted days of rest per week. This rest period can generally include Saturday afternoon or Monday morning combined with a full day. Furthermore, these rest periods may be accumulated for up to fourteen days if workers choose to take their time off in blocks.
The law also addresses daily breaks, though whether short pauses—such as meal breaks or 15-minute intervals—count as active working time depends on whether the employee remains under the employer's control during that period.
