In Spain, inheriting real estate involves complex tax obligations and legal protections for tenants. To address liquidity issues, heirs can request a payment extension for inheritance tax of up to five years by using the inherited property as collateral. This allows families to avoid renouncing legacies due to a lack of immediate funds.

Taxation varies significantly by autonomous community. For instance, Madrid and Valencia offer a 99% tax bonus, whereas regions like Catalonia impose a higher tax burden. The tax calculation is based on the cadastral reference value, and the amount paid influences future capital gains taxes if the property is later sold.

Regarding rental continuity, Spanish law protects tenants when a landlord passes away. Heirs subrogate into the existing contract, meaning they must respect all previously agreed terms, including rent amounts and contract duration. They cannot unilaterally modify conditions or terminate the lease solely because of the inheritance.
