Spain Supreme Court declares telework fatality a workplace accident
The Spanish Supreme Court (Sala Cuarta) ruled on 23 April 2026 that the death of a senior administrative technician employed by Accenture Outsourcing Services S.A.U. while teleworking from her home in Madrid constitutes a work‑related accident. The employee suffered an acute myocardial infarction on 21 February 2022 and was found dead at around 20:00. The Court held that, because the employer did not provide a detailed hourly record showing whether the worker was performing duties, resting, or on a break, the burden of proof lies with the company. The decision establishes a practical doctrine that, in the absence of precise time‑keeping, doubts cannot be resolved against the worker or her beneficiaries.
