Spain tax regulations for real estate and inheritance
In Spain, taxpayers can utilize various legal mechanisms to reduce their tax burden regarding real estate and inheritance. Under inheritance tax regulations, heirs with a recognized disability of 33% or higher are entitled to a reduction of 150,253 euros from the taxable base. This reduction requires an official certificate and applies nationally, though specific regional regulations may offer additional benefits.
Regarding the sale of a primary residence, owners may be exempt from paying Personal Income Tax (IRPF) on capital gains. Individuals under the age of 65 can achieve this by reinvesting the total sale proceeds into a new primary residence within a two-year period. Conversely, those aged 65 or older are exempt from this tax without the obligation to reinvest the funds. To qualify, the property must have served as the owner's habitual residence for at least three continuous years.
When selling property without a real estate agency, owners avoid commission fees but must personally manage pricing, marketing, viewings, and negotiations. The net financial outcome depends on whether the savings from avoiding fees are offset by a lower final sale price or increased operational costs.
