Spain tightens cryptocurrency regulations and ends ATM anonymity
Spain has implemented stricter regulations for the cryptocurrency sector following the end of the MiCA (Markets in Crypto-Assets) transitional period on July 1, 2026. Under these rules, only authorized companies can offer crypto-asset services in the country. Investors are advised to verify providers through the European Securities and Markets Authority (ESMA) MiCA registry and the National Securities Market Commission (CNMV), as the Bank of Spain's previous registry is no longer valid for authorization purposes.
Additionally, Royal Decree 813/2026 has effectively ended anonymity for cryptocurrency ATM users in Spain. The decree mandates identity verification (KYC) for every transaction, regardless of the amount, eliminating previous exemptions for small trades. Digital National Identity Documents are recognized as valid for this process, and identification data must be retained for ten years. These measures aim to reduce untraceable fund movements by extending controls to money transfers and other exchange points.
