Spain's CBD and medicinal cannabis sectors expand under new regulations

The cannabidiol (CBD) and medicinal cannabis sectors in Spain are undergoing significant economic and regulatory shifts. The CBD market is emerging as a growing economic driver, involving industrial hemp production, specialized distribution, and biochemical analysis laboratories. However, companies face a complex legal landscape where European regulations allow the movement of industrial hemp derivatives, while local Spanish laws maintain strict restrictions on specific commercial formats.

In the medical field, the landscape changed following the approval of Royal Decree 903/2025. This regulation governs the use of standardized cannabis preparations for therapeutic purposes when conventional treatments are insufficient. Under these rules, products must be registered with the Spanish Agency of Medicines and Medical Devices (AEMPS). Prescription is limited to medical specialists, and the preparation and dispensing of these formulas must occur exclusively through hospital pharmacy services to ensure controlled dosing and clinical monitoring.
