Spain's DGT Enforces New Emergency Lane Rule and Overtaking Fines Starting 2026

From 1 October 2026, Spain's Directorate General of Traffic (DGT) will make it mandatory for drivers caught in a traffic jam on any highway or motorway to move to the road margins, creating a central emergency lane for ambulances, fire services and police. The rule applies to all vehicle types, including cars, motorcycles, vans and heavy trucks, with no weather or vehicle‑type exemptions. Non‑compliance will be punishable with a fine estimated to exceed €200.

The same regulatory update retains a €200 fine for overtaking on a continuous line, with a possible deduction of up to four licence points when the maneuver is performed in low‑visibility conditions, on curves or where it endangers other road users. The DGT notes that points are only removed when the overtaking poses a clear safety risk, and outlines exceptions such as avoiding obstacles or overtaking cyclists under safe conditions.
