Spanish Constitutional Court magistrates dissent over embezzlement amnesty

Five magistrates of Spain's Constitutional Court have issued a dissenting opinion against the majority decision to grant amnesty for embezzlement crimes related to the Catalan independence movement. The dissenting judges, including Ricardo Enríquez and Enrique Arnaldo, argue that the court is overstepping its jurisdiction and ‘supplanting’ the Supreme Court by dictating how ordinary legality should be interpreted.

The majority ruling, which could facilitate the return of former Catalan president Carles Puigdemont, is expected to endorse the amnesty for leaders such as Jordi Turull and Dolors Bassa. Constitutional Court President Cándido Conde-Pumpido has criticized the Supreme Court's previous interpretation of the amnesty law, suggesting it was contrary to the law's spirit and purpose.

The dissenting magistrates expressed concern that the court's current trajectory distorts its functional role within the national justice system and uses unacceptable language to criticize the Supreme Court's Second Chamber.
