Spanish court acquits waiter of 90,000 euro theft charge

The High Court of Justice of Andalusia (TSJA) has overturned the conviction of a waiter in Córdoba who was initially sentenced to three and a half years in prison for the alleged theft of 90,000 euros from a business cash register.

The TSJA ruled that the evidence provided was insufficient to prove the large-scale theft. While the initial sentence from the Provincial Court of Córdoba held that the employee exploited deficient accounting controls between 2012 and 2017, the TSJA found that only four specific instances of theft could be verified, totaling 90 euros.

The court noted that recordings, testimonies, and the defendant's economic status did not establish a solid link to the much larger sum alleged by the prosecution. The defense's appeal was upheld, though the ruling remains subject to potential challenge before the Supreme Court.
