Spanish courts block Madrid low‑emission zone articles and cancel Mogán tourist tax

Madrid’s city council approved a new mobility ordinance (Ordenanza 2/2026) in March 2026 after the Spanish Supreme Court upheld the annulment of key provisions of the previous low‑emission zone (ZBE) rule. The updated ordinance, effective in April, keeps the general ZBE and special protection zones in the city centre, while other Spanish cities such as Las Palmas and several towns in the Basque Country remain in the preparatory stage.

In the Canary Islands, the Superior Court of Justice of the Canary Islands (TSJC) overturned the tourist tax introduced by the municipality of Mogán in 2025. The court found the tax unconstitutional because it did not correspond to a clearly defined service and served primarily as a revenue‑raising tool. The tax, previously suspended pending the legal challenge, is now permanently void, affecting local hospitality businesses and tourists who would have paid a nightly charge.
