Spanish courts rule against banks in consumer protection cases

Spanish courts have issued rulings favoring consumers in cases involving banking errors and fraud. The Supreme Court ordered Cofidis to pay 2,000 euros in compensation to a client after the company illegitimately included her in the ASNEF credit delinquency file. The court ruled that the debt was being legally contested for usury, meaning it lacked the required certainty for such a listing.

In a separate case, the Provincial Court of Madrid ordered ING to return 35,000 euros to an elderly couple who fell victim to a phishing scam. The court determined that the victims and their son acted with maximum diligence and that the bank was responsible for failing to protect them from a sophisticated mirror website used by hackers to steal credentials.
