Spanish courts rule against CaixaBank and local company in consumer and labor disputes
A court in Santiago de Compostela has annulled a revolving credit card contract held with CaixaBank Payments & Consumer. The ruling found the 2018 contract abusive due to a lack of transparency regarding interest rates and the deferred payment system. The court noted the bank failed to sufficiently inform the client of the economic consequences, specifically the risk of debt prolongation and minimal capital amortization. Consequently, the bank must return all amounts paid by the client that exceed the actual capital used.
In a separate legal matter, the High Court of Justice of Galicia annulled an 11-day suspension and salary deduction imposed on a worker. The court ruled that the company's disciplinary action violated fundamental rights and lacked internal regulatory basis. The worker, a personnel delegate, had allowed a colleague on medical leave to access the facility for a union meeting. The court ordered the company to pay 7,501 euros in compensation for moral damages, determining the sanction acted as a reprisal in a hostile work environment.
