Spanish courts rule in favor of Freixenet and approve Frutas Lozano restructuring
The Provincial Court of Barcelona has ruled in favor of Freixenet, rejecting a claim for over 1.7 million euros. The lawsuit, brought by the owner of the LOE Experience beverage range, alleged that Freixenet breached a 2017 exclusive distribution contract by failing to meet sales targets and discontinuing certain products following the acquisition of a 50.7% stake in Freixenet by the German group Henkel.
The plaintiff sought approximately 1.7 million euros in damages, primarily for lost net income. However, the court confirmed a previous ruling stating that the alleged breach of contract was not sufficiently proven to justify the compensation.
In a separate business development, the Court of Huesca has approved a restructuring plan for the Frutas Lozano group. The plan involves four companies—Frutas Lozano, Torreblanca, Belofruta, and Frutas Rosa Verano 2020—and will reduce the group's total debt from 17.5 million to 4.3 million euros. This follows a previous failed restructuring attempt and includes debt write-offs totaling 13.2 million euros, representing roughly 75% of the restructured debt.
