Spanish courts rule on Telefónica and Aena telecommunications disputes

The National Court (Audiencia Nacional) has partially ruled in favor of Telefónica regarding a dispute with the National Markets and Competition Commission (CNMC) over agreements with Yoigo. While the core of the regulator's decision remains intact, the court partially annulled the sanction and recognized Telefónica's right to be compensated for the costs associated with maintaining the bank guarantee used to suspend the fine's payment.

In a separate matter, the Ministry of Finance has lifted the suspension on Aena's tender for 4G and 5G mobile network infrastructure across 15 Spanish airports. The suspension followed an appeal by Vodafone against technical specification changes that significantly increased the required coverage area. The Central Administrative Tribunal for Contractual Appeals (TACRC) annulled the modification of the technical specifications, allowing the approximately 125 million euro contract process to proceed.
