Carles Puigdemont denied amnesty by Spanish Supreme Court
The Spanish Supreme Court has rejected the application of the Amnesty Law for Carles Puigdemont, the former president of Catalonia, regarding charges of embezzlement. Magistrate Pablo Llarena maintained the refusal, citing the alleged intent to obtain personal patrimonial benefit as a primary reason for exclusion from the amnesty.
While a recent ruling by the Court of Justice of the European Union (CJEU) clarified that the secessionist actions did not harm the financial interests of the European Union, Llarena noted that this decision does not invalidate the separate argument concerning personal patrimonial gain. Consequently, the national arrest warrant against Puigdemont and former official Toni Comín remains in effect.
The magistrate also dismissed requests to transfer the case to the High Court of Justice of Catalonia or to archive the proceedings based on the 'non bis in ídem' principle. The legal situation remains pending further decisions from the Spanish Constitutional Court regarding the overall constitutionality of the amnesty law and specific appeals filed by independence leaders.
