Spanish labor law protections for work schedule changes
Under Spanish labor law, specifically Article 41 of the Workers' Statute, employees have specific protections regarding substantial modifications to their working conditions, such as changes to work schedules or time distribution.
If a company implements a schedule change that negatively impacts an employee's ability to balance work and personal life, the employee may have the right to terminate their contract and receive severance pay. This compensation is set at 20 days of salary per year worked, prorated for months, with a maximum limit of nine monthly payments.
To implement such a change, companies must notify the worker and their legal representatives at least 15 days in advance. Employees who disagree with the modification but choose not to terminate their contract may also challenge the decision through social jurisdiction.
