Spanish Labor Law Secures Vacation Days for Workers Who Fall Ill
Under article 38.3 of Spain's Statute of Workers, vacation days that coincide with a temporary incapacity, such as a medical sick leave, are suspended and do not count as taken. The employee may resume those days after recovery, with a statutory deadline of 18 months from the end of the calendar year in which the vacation was generated. An exception applies to maternity‑related leaves, which are not subject to the 18‑month limit.
