Spanish Low Emission Zones face legal rulings and implementation delays
Spanish municipalities are facing diverse challenges in implementing Low Emission Zones (ZBE). In Malaga, the High Court of Justice of Andalusia annulled the city's circulation regime, ruling that the policy was discriminatory. The court found that the system unfairly penalized drivers based on where their vehicles were registered, violating principles of market unity and freedom of enterprise.
In Parla, the local government is launching a ZBE that focuses on regulated parking rather than permanent traffic restrictions. Access to the city center will only be limited during extreme pollution episodes. Residents with locally registered vehicles will be exempt from parking fees.
Meanwhile, El Puerto remains significantly behind in its implementation. Despite legal requirements for cities with over 50,000 inhabitants to establish these zones, the city has yet to deploy an operational system or define specific restrictions, despite pressure from the Ombudsman.
